These general terms and conditions of sale determine the sale of all products on offer on the www.firplast.com website by FIRPLAST.

2. Applicable law

" All orders are subject to French law. All contractual information is presented in French and all products offered for sale are compliant with French regulations. When required, it falls to the client to verify with the local authorities concerning the products which the client intends to order. Firplast is in no way liable if the product isn't in accordance with the regulations of the foreign country where it is delivered.
In case of litigation, only French courts will have jurisdiction".

3. Product presentation

" The distinctive features of the products offered for sale are presented in their product information sheet. The attached photos do not have contractual value. Firplast is in no way liable for any mistakes that may remain in these information sheets. All texts and images on display on the FIRPLAST website are reserved, on a world-wide scale, under copyright and intellectual property laws. Any reproduction, in part or in whole, is strictly prohibited".

4. Validity period for sale offers

All products are offered for sale until full depletion of stocks. In case of an order for an unavailable product, the client will be informed of its unavailability as quickly as possible.
Firplast may replace an unavailable item with another item of similar stock and identical or superior quality at the same price.

5. Product prices

The "Our products" section of our website shows the prices in euros before tax and without shipping costs. The VAT and shipping costs will appear on the screen after the client has finished selecting their products.
FIRPLAST reserves the right to modify its prices at any time, however, the ordered items will be charged at the price in effect when the order is formally acknowledged.

6. Ordering

6.1 Creation of a user account
In order to make an online order, the Client must create a user account or open a session if they already have a user account.
They can access the various services available on the website by entering their username and password (both can be modified at any time by accessing the "My account" section).
In case of the loss or unauthorised use of their user account, username, and password, the Client must immediately inform FIRPLAST.
The Client agrees to not divulge their username and password. The Client alone is responsible for their use.
Any attempt to subvert the username or password of another client is strictly prohibited and can incur penal sanctions.

6.2 Deactivating a user account
FIRPLAST reserves the right to deactivate the user accounts of their clients, without notice or compensation, in case of:

Non-compliance with these General Terms and Conditions of Sale;
Non-payment of any owed sum;
Issuance of false information at the creation of said user account.

6.3 Order acceptance process
To be accepted, the Client's order must include all information necessary to its processing.
The Client confirms their order when they click the "CONFIRM ORDER" button at the bottom of the "Order confirmation" page. They thereby accept the ordering process and these General Terms and Conditions of Sale.
FIRPLAST then confirms the order by email; an email that recapitulates all the details of the order.

7. Delivery

All available products will be dispatched within an average 2-day timeframe (for any order placed before midnight) from:

  • time of order for payment by credit card,
  • time of receipt of payment by Firplast for payment by cheque or transfer,
  • time of receipt of the signed and stamped purchase order with the header of the public body in case of payment by government-issue administrative orders.

The products are transported at the buyer's own risk. In case of delivery damages or missing items, the buyer must specify their misgivings on the delivery slip and confirm them, within the three days following the delivery, by way of a certified letter with acknowledgement of receipt addressed to the carrier".

8. After-sale customer service

" For any information, question, or claim, the Client can get in touch with Firplast's Customer Relations Service at the following number: +33 4 72 23 66 66, Mondays to Fridays, 9 to 12 o'clock in the morning and 2 to 5 o'clock in the afternoon."

9. Transport

A flat-rate contribution of 15 Euros before tax will be required for processing fees for metropolitan France. For all other destinations, please contact us.
Shipping is free for any order of 190 euros or over before tax.

10. Satisfaction guarantee

" The Client has 14 days from the delivery date to return the product. Both dispatch and return shipping costs are at their expense. They will then be reimbursed of the price of product within a month of Firplast receiving the returned item. All items must be returned in their original packaging and in mint condition so that they may be put back on sale. Any products that are partially returned or returned damaged or dirtied will not be accepted".

NB: this clause is only valid for private individuals, not for professionals.
Right of withdrawal is not applicable for products made according to a Client's specifications, for customised products, or for products that, due to their nature, cannot be returned or may deteriorate or expire rapidly.


11. Data confidentiality

"No personal data supplied by the client will be released to a third party. Personal data will be integrated into Firplast's client database, except in case of explicit opposition on the client's part.
In accordance with Act n°78-17 of the 6th of January 1978, the client has the right to access and/or modify their personal data at any time. In order to do so, they must contact Firplast's Customer Relations Service."

12. Payment

All payments will be settled in euros.

Means of payment
The user can settle their payments:

  • online at the time of the order, by card (credit card, mastercard, visa). In this case, our website uses an SSL (Secure Socket Loyer) type 128 bit secure payment module of the BNP Paribas bank, MERCANET solution.
  • by cheque, transfer, or government-issue administrative order from the French public administration with enclosed order form for all clients without an open account in our books.

The order form appears on the client's screen after order confirmation. They must print it out, enclose it with their cheque or the signed and stamped purchase order with the header of the public body in case of payment by government-issue administrative orders, and send it to the following address:

The client has eight days to send the cheque by mail or to complete the transfer. Failing receipt of payment within this timeframe, the order will be automatically cancelled.

Non-payment
FIRPLAST reserves the right to refuse to carry out a delivery to or to honour an order from a client with whom a settlement dispute is pending.


Title-retention clause
All products remain under FIRPLAST's ownership until full settlement of the price of the order.
This title-retention clause does not stop the Client from taking on all risks of loss or damage to the products from the moment they are dispatched.
The products are transported at the client's own risks. They will be able submit a claim to the carrier in case of damages in accordance with the prevailing laws and regulations.

13. Late payment penalties

In the case of sale to a professional, late payment penalties will be due from the day after the payment date present on the invoice. These penalties will be charged at three times the legal interest rate.
